Calmentum — Terms of Service

Document version: terms-v3
Last updated: 2 November 2026

1. Who we are, and what these terms cover

These Terms of Service ("Terms") are an agreement between you and Calmentum EOOD ("Calmentum", "we", "us"), and govern your use of the Calmentum mobile app and its supporting services (the "Service").

By creating an account or using the Service you accept these Terms. If you do not accept them, do not use the Service.

Our Privacy Policy explains how we handle your personal data and forms part of these Terms.

2. Eligibility

You must be at least 16 years old and legally able to enter a contract. If you use Calmentum on behalf of an organisation, you confirm you are authorised to bind it.

3. Calmentum is not a medical service

This section matters. Please read it.

Calmentum is a productivity and personal-planning tool. Its recovery features — energy and stress check-ins, burnout-risk indicators, recovery states, reset days and comeback plans — are self-reflection aids, not clinical instruments.

If you are in crisis or thinking about harming yourself, contact your local emergency number or a crisis line immediately. Calmentum's circle and buddy features connect you to other app users, who are not trained responders and cannot help in an emergency.

Examples of where to turn: 112 (EU-wide emergency number, including Bulgaria), 988 (Suicide and Crisis Lifeline, US and Canada), 116 123 (Samaritans, UK and Ireland).

Movement sessions

The Move sessions — breathing, walking and running, yoga, stretching and light bodyweight training — are general guidance for healthy adults, not a programme designed for you or your body.

4. Your account

You are responsible for keeping your credentials secure and for activity under your account. Give us accurate information and keep it current. Tell us promptly at support@calmentum.com if you suspect unauthorised access. We may suspend an account we reasonably believe is compromised or is being used in breach of these Terms.

One person, one account. Do not share, sell, or transfer your account.

5. Your content

You keep ownership of everything you create in Calmentum — tasks, notes, check-ins, journal pages, photos, posts and comments ("Your Content").

You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display Your Content solely to operate and improve the Service for you. Where you deliberately publish content — posting to the feed or sharing into a circle — that licence extends to showing it to the users you shared it with. This licence ends when you delete the content or your account, except for copies retained in backups for the period stated in the Privacy Policy, and for content others have already legitimately received.

We do not use Your Content to train machine-learning models.

You are responsible for Your Content. Do not upload anything you do not have the rights to.

6. Community rules

Calmentum includes a community feed, circles and buddies. When you use them, you must not:

Support circles are private spaces built for encouragement. Treat what other people share there as confidential.

Report anything that breaks these rules with the in-app report function. We may remove content and suspend or terminate accounts for breaches. We are not obliged to monitor content, but we may.

7. Acceptable use of the Service

Do not: reverse engineer, decompile, or attempt to derive our source code except where that restriction is unenforceable by law; probe, scan, or breach our security; access the Service by automated means without our written permission; resell or commercially exploit the Service; circumvent rate limits or usage restrictions; or use the Service to build a competing product.

8. Availability and changes

We aim to keep Calmentum available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features at any time. Where a change materially reduces core functionality we will give reasonable notice.

Some features may be offered as beta or experimental. These are provided as-is and may change or be withdrawn without notice.

9. Paid features

Calmentum is currently provided free of charge. The free version is supported by ads, provided by Google AdMob; the Privacy Policy (section 3.8) explains what that involves and the choices you have. If we introduce paid features we will publish pricing, billing, renewal, and refund terms before you are asked to pay. Any future in-app purchases would be processed by the Apple App Store or Google Play under their own terms, alongside your statutory withdrawal and refund rights as a consumer.

10. Ending this agreement

You may stop using Calmentum at any time and delete your account in Settings → Delete account.

We may suspend or terminate your access if you materially breach these Terms, if we are required to by law, or if we discontinue the Service. Except where the breach is serious or we are legally prevented, we will give notice and a chance to fix the problem.

On termination your right to use the Service ends. Sections 3, 5 (as to licences already granted), 11, 12, 13, and 15 survive.

11. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will meet your requirements, that it will be uninterrupted or error-free, or that any plan, suggestion, insight, or wellbeing indicator it produces is accurate, complete, or suitable for you.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep all mandatory statutory rights under the law of your country of residence, and nothing here overrides them.

12. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Service.

Our total aggregate liability arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, and (b) EUR 50.

13. Your responsibility for Your Content

If a third party brings a claim against us because content you uploaded was unlawful or infringed their rights, or because you used the Service in deliberate breach of these Terms, you agree to compensate us for the damages and reasonable costs that claim causes us. This section does not limit any mandatory consumer rights you hold.

14. Changes to these Terms

We may update these Terms. The version identifier at the top changes when we do. For material changes we will notify you in the app and ask you to accept the new version before you continue using the Service. If you do not accept, you may stop using Calmentum and delete your account.

15. Governing law and disputes

These Terms are governed by the laws of the Republic of Bulgaria, without regard to conflict-of-law rules. Disputes will be resolved by the competent courts of Bulgaria.

If you are a consumer in the EEA or UK, you keep the protection of the mandatory laws of your country of residence and may bring proceedings there.

16. General

These Terms and the Privacy Policy are the entire agreement between us regarding the Service. If a provision is found unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, incorporation of the Service into a company, or sale of assets.
